Agreement to Terms

Welcome to List.my, a property insights platform operated by Mosets Consulting (referred to as "Mosets," "we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.

Description of Services

List.my provides a platform for accessing property market data, subsale transaction information, property listings, and related real estate insights across Malaysia. Our services include:

• Property transaction data and historical pricing information
• Market trends and analytics for various locations
• User-generated property listings
• Property search and comparison tools
• Bookmarking and location tracking features
• Property insights and reports

User Accounts

Account Creation

To access certain features of our services, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violating these Terms or for any other reason we deem appropriate. You may also delete your account at any time through your account settings.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use our services in any way that violates any applicable law or regulation
• Engage in any fraudulent, deceptive, or misleading activity
• Scrape, harvest, or collect data from our services using automated means without our express written permission
• Attempt to gain unauthorized access to our systems or other users' accounts
• Transmit any viruses, malware, or other malicious code
• Interfere with or disrupt the integrity or performance of our services
• Impersonate any person or entity or falsely state or misrepresent your affiliation
• Post or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Use our services to spam, solicit, or advertise without our prior written consent
• Reverse engineer, decompile, or disassemble any portion of our services

User-Generated Content

Your Content

You may be able to post, upload, or submit content to our services, including property listings, images, reviews, and comments ("User Content"). You retain ownership of your User Content, but by posting it on our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content in connection with our services.

Your Rights in What You Upload

You are responsible for having the rights to everything you upload. By submitting User Content, you confirm that:

• You own the copyright in it, or you hold a licence that allows you to use it here and to grant us the licence described above
• It is not subject to any assignment, exclusive licence or other agreement with a third party — including another property portal, a photographer, or a developer — that would prevent you from posting it on List.my
• Where a person can be identified in it, you have their consent to publish it
• It describes a real property that you are authorised to advertise, and the details are accurate as at the date you post them

If any of this stops being true after you post — for example, a third party tells you they own the images — you must tell us and remove or amend the listing promptly.

Bringing Listings From Another Platform

You may want to move a listing you already advertise elsewhere onto List.my. You are welcome to, on these terms.

• You supply the content. Send us your own photographs, floor plans and descriptions — the original files you hold. We do not copy, download or retrieve listing content from another platform on your behalf, whether you ask us to or not.
• The listing must be yours. It must be a property you are advertising as the owner, or one you are appointed to market as a registered estate agent, negotiator or firm.
• Check your obligations to the other platform. Some portals claim ownership of listing text and photographs, or restrict where else you may publish them. Those are terms between you and that portal. You are responsible for reading them and deciding whether you may move your listing. We cannot advise you on this, and if you are unsure you should get your own legal advice.
• We may ask you to prove the listing is yours. This can include matching your verified REN, REA or PEA number, or the phone number shown on the original advertisement. We may decline or remove an import where we cannot reasonably establish that it belongs to you.

Content Standards

All User Content must:

• Be accurate and not misleading
• Comply with all applicable laws and regulations
• Not infringe on any third-party rights, including intellectual property rights
• Not contain offensive, discriminatory, or inappropriate material
• Not contain private or confidential information without proper authorization

Content Moderation

We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, without notice, for any reason including violation of these Terms.

Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, images, software, and data compilations, are owned by Mosets Consulting, our licensors, or other content providers and are protected by Malaysian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our content except as expressly permitted in these Terms or with our prior written consent.

Copyright Complaints and Takedown

If you believe something published on List.my infringes your copyright or another right you hold, tell us and we will look into it. Please include:

• The address (URL) of the listing or page concerned
• A description of the material you say is yours, and enough detail for us to find it on the page
• The basis of your claim — for example, that you took the photographs, or that you hold an assignment of the copyright
• Your name, organisation and contact details

We will acknowledge your complaint and, where it appears well founded, remove or restrict access to the material while we look into it. We will tell the person who posted it and give them a chance to respond. If they satisfy us that they were entitled to post it, we may restore it and will let you know.

Repeat infringement will lead to the account being suspended or closed. Send complaints through our contact form.

Data Accuracy and Disclaimer

While we strive to provide accurate and up-to-date property information, we cannot guarantee the accuracy, completeness, or reliability of any data or content on our platform. Property data is sourced from various sources including government records and user submissions, and may contain errors or omissions.

You acknowledge that:

• Our services are for informational purposes only
• We are not real estate agents, brokers, or financial advisors
• You should conduct your own due diligence before making any property decisions
• We do not endorse or verify any user-generated listings or content
• Property valuations and insights are estimates and should not be relied upon as professional advice

Third-Party Links and Services

Our services may contain links to third-party websites, services, or resources. We do not control, endorse, or assume responsibility for any third-party content, privacy policies, or practices. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party websites or services.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOSETS CONSULTING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content
• Any property decisions made based on information from our services

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Indemnification

You agree to indemnify, defend, and hold harmless Mosets Consulting, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable legal fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing our services using your account.

This includes any claim by a third party that User Content you submitted infringes their copyright or other rights, or that you were not entitled to publish it here — including a claim brought by another property portal, a photographer, a developer or a former employer in respect of a listing you brought across from another platform.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or our services shall be resolved through good faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published on our services, constitute the entire agreement between you and Mosets Consulting regarding your use of our services and supersede all prior agreements and understandings.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
